New Bankruptcy Laws – Permanent Changes in Discharging Debt Through Bankruptcy
The Bankruptcy Abuse Prevention and Consumer Protection Act became law in 2005 with the objective of preventing widespread abuse and to teach people to more effectively manage their personal finances. Earlier, people resorted to filing under Chapter 7 which helped them to protect their income. The new laws state that to pursue the option of filing for bankruptcy under Chapter 7, a person should not have filed for bankruptcy in the previous 8 years.
Another change under the new law is that the filer’s income must be below or equal to the state median (income of a household of your size in your state) to qualify for a Chapter 7 filing. A means test would be conducted to find out your disposable income (by subtracting certain allowed expenses and required debt payments from your monthly income) and if the amount crosses a certain limit, you will not be eligible to file for Chapter 7 bankruptcy.
Any non-exempt assets that the filer has in his possession will need to be handed to a court-appointed trustee in order that they can be sold. These include, but aren’t limited to, a luxury car, jewellery, art work or a second home. Property will be taken at replacement value after calculating depreciation and not at auction value.
If the debtor is unable to comply with the changed laws, (s)he would need to file for bankruptcy under Chapter 13. In a Chapter 13 bankruptcy, the filer can use his / her income to pay off the creditors, generally during a period of three to five years depending on the size of the debts and income instead of liquidating property. The debtor will be afforded the same court protection from creditors as they’d receive from filing chapter 7 bankruptcies.
The new law also requires the debtor to undergo credit counseling with an agency approved by the United States Trustee’s office. The counseling would indicate whether you really need to file for bankruptcy or come up with a repayment plan – which needs to be produced in court at the time of filing. The debtor is also required to furnish a certificate showing that (s)he has completed the counseling. At the end of the bankruptcy case, the debtor is also mandated to attend a personal finance management course with the counseling center.
